Blue Mountains Council has been directed to re-assess a freedom of information application made by the Gazette.
The paper sought access to a report on the Wayzgoose building in Leura Mall, a matter dealt with by council in a closed session.
Council initially refused but after an appeal provided a copy which was heavily redacted.
The Gazette took the case to the Information and Privacy Commissioner, who recommended that council makes a new decision.
Council had cited seven clauses from the act to justify the redaction.
But the commissioner said council simply reiterated the words from the legislation, rather than showing how they applied to the report.
“On this basis, we are not satisfied that [council’s] decision to refuse to provide access to the information is justified.”
