A Blackheath artist who was fined $750 for recklessly riding a bicycle without a helmet in last year’s Rhododendron Festival parade has had the fines dismissed.
Robin Martin fronted Katoomba Local Court in April to appeal the fines after his initial plea for leniency was rejected by the State Debt Recovery Office.
Police had fined the 65-year-old $433 for riding a bicycle recklessly and $325 for not wearing a helmet while he was participating in last year’s Rhododendron Day parade.
Mr Martin had been wearing a wig and funny mask while cycling in between slow-moving vintage cars during the parade.
The Katoomba magistrate found him guilty of the offences but dismissed the case with no fines or court costs to be paid.
A relieved Mr Martin said he wanted to express his “heart-felt gratitude” to all those from Blackheath and the wider Blue Mountains who offered him support.
“I also want to thank the members and presidents of the Blackheath Chamber of Commerce and the Rhodo Festival Committee for their help by writing reference letters in my defence,” he said.
Mr Martin’s case elicited much interest in Blackheath, with more than 500 signatures collected on petitions requesting leniency.
Mr Martin thanked Jan and staff at The Veggie Patch, and David and Octavia at The Blackheath Community Op-shop for helping to collect the signatures.
“Also thanks very much to Father Paul for his keen interest and advice on legal matters.”
Mr Martin revealed that many people had offered money to help pay the fines, including an anonymous donor called “Pat”.
“After reading of my issue in the Gazette, Pat contacted me saying that he/she was prepared to pay the whole amount for me,” an amazed Mr Martin said.
“I am now looking forward to participating in this year's festival and parade - definitely wearing a helmet!”
