An attempt by council to get a 40 km/h speed limit along Railway Parade, Leura, has been rebuffed, with the ball firmly returned to council’s court.
Council wrote to the RMS earlier this year, asking that it consider the slower speed along the section of the road west of Leura Mall because of concerns raised by residents about safety.
There is no footpath, apart from a very short stretch of a few metres, and pedestrians are forced to walk on the road.
But the response hands responsibility back to council.
Ed Scully, director of Network West precinct, wrote: “Roads and Maritime has previously highlighted that to authorise a 40km/h speed zone, a section of road must already have sufficient traffic calming measures and pedestrian friendly footways.”
And that was the responsibility of council because it is a local road.
“A reduction in speed limit should not be viewed as an alternative to the provision of adequate pedestrian facilities,” Mr Scully wrote.
